House Subcommittee Passes Bill For Less FDA Regulation On E-Cigs

The US House Appropriations Rural Development, Food and Drug Administration and Related

Agencies Subcommittee on June 18th passed an agriculture appropriations bill that would prevent the FDA

Center for Tobacco Products from requiring potentially costly pre-market reviews of e-cigs and other currently

unregulated products that are already on the market, while still allowing the agency to ban underage sales and

set certain product standards, with Republicans saying the lengthy and expensive pre-market review process

could drive companies out of business, and the bill’s sponsor US Rep. Robert Aderholt (R-Alabama) explaining

that the provision is merely a technical change that would keep the newer products under FDA oversight and

regulated in the same way as older tobacco products that were on the market as of February 15, 2007. Some

health groups said the bill that passed the House subcommittee would hamper the FDA’s ability to prevent

manufacturers from marketing new products to children. As part of a broader rule aimed at regulating e-cigs and

other currently unregulated products, the FDA has proposed that e-cigs that entered the market after February

15, 2007, undergo pre-market reviews retroactively after the final rule is approved. Companies would be

required to submit the applications within two years of the final rule. The proposed rules are expected to be

finalized in the coming months. FDA spokesman Michael Felberbaum said the rules are important consumer

protections, and “as we learn more about these products, the agency will have additional opportunities over the

long term to make a positive difference in the public health burden of tobacco use in this country” (AP 6/19)
